Please read these Terms carefully. They govern your access to and use of the VivaLongevity website, the products offered for sale, and any related services.

1. Acceptance of Terms

By accessing or using this website (the “Site”), creating an account, or placing an order, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you may not use the Site.

2. Eligibility & Age Verification

To use this Site and purchase products, you represent and warrant that you:

Are at least 21 years of age and of legal capacity to enter contracts;
Are a qualified researcher, scientist, laboratory professional, or affiliated with a research institution;
Will use any purchased materials strictly for non-clinical laboratory research purposes; and
Have reviewed and accepted the age-gate disclaimer presented upon entry.

We reserve the right to verify age, identity, and professional affiliation and to refuse service at our sole discretion.

3. Research Use Only

Products offered on this Site are research chemicals provided for laboratory and research applications only. You expressly acknowledge and agree that:

Products are not intended to diagnose, treat, cure, mitigate, or prevent any disease;
Products are not intended for human or veterinary consumption, topical application, injection, or any in vivo use;
Statements made on the Site have not been evaluated by the U.S. Food and Drug Administration (FDA), EMA, Health Canada, or any comparable regulator;
You are solely responsible for ensuring your intended research use complies with all applicable federal, state, provincial, and local laws, including import/export regulations; and
Any misuse — including, without limitation, administration to humans or animals, resale for such purposes, or distribution to unqualified parties — is strictly prohibited and will void all warranties.

4. Orders, Pricing & Payment

All orders are offers to purchase subject to our acceptance. We may refuse, cancel, or limit any order, including orders that appear fraudulent, mis-priced, or placed by ineligible purchasers.

Pricing: Prices are listed in U.S. dollars and may change without notice. Promotional pricing applies only while available.
Payment: Payments are processed by Stripe. By submitting payment information you authorize us (via Stripe) to charge the listed amount plus applicable shipping and taxes.
Taxes: Sales, use, and similar taxes are calculated at checkout based on your shipping destination.
Order confirmation: An emailed confirmation constitutes receipt, not acceptance, of your order. Acceptance occurs upon shipment.

5. Shipping & Restrictions

We ship to addresses within the United States and to qualifying international research addresses. You are responsible for ensuring that receipt, possession, and use of products are lawful at your destination.

Processing: Orders typically ship within 1–3 business days after payment clears and verification is complete.
Domestic shipping: Free standard shipping on all U.S. orders; priority shipping is complimentary for active subscribers.
International shipping: Where available, buyers are responsible for all duties, taxes, brokerage fees, and compliance with import regulations.
Prohibited destinations: We do not ship to jurisdictions where the sale of research chemicals is restricted or prohibited, nor to P.O. boxes for temperature-sensitive items.
Recipient responsibility: Upon carrier delivery, risk of loss passes to you. We are not liable for customs seizure, refused deliveries, or theft after successful delivery.
Age verification at delivery: Certain shipments may require an adult signature.

6. Returns & Refunds

Because our products are sensitive research materials, we enforce a strict returns policy to ensure product integrity for all researchers.

All sales final once a vial is opened, reconstituted, or its tamper-evident seal broken.
Damaged or defective shipments: Report within 72 hours of delivery with photographs for replacement or refund.
Carrier-lost packages: Reported within 14 days of the expected delivery date will be re-shipped or refunded after carrier investigation.
Order cancellations: May be requested before shipment by emailing support. Once shipped, the returns policy above applies.
Refund method: Approved refunds are issued to the original payment method within 5–10 business days after we receive the returned item (if applicable).
Restocking: Returns accepted outside the conditions above may be subject to a 20% restocking fee at our discretion.

7. Subscriptions

Subscriptions renew automatically on the cadence you select (e.g., every 30 or 60 days) until canceled. You may cancel or modify your subscription from your account dashboard at any time before the next renewal date. Subscribers receive a standing discount, complimentary priority shipping, early access to new launches, and loyalty bonuses unlocked at 3, 6, and 12 consecutive deliveries.

8. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

9. Intellectual Property

All content on the Site — including text, graphics, logos, product data, COAs, and software — is owned by VivaLongevity or our licensors and is protected by intellectual-property laws. You may not copy, redistribute, scrape, or exploit any portion of the Site without our prior written consent, except for reasonable, non-commercial research reference.

10. Prohibited Conduct

Reselling, re-labeling, or distributing products to unqualified third parties;
Using products for human or animal administration of any kind;
Attempting to reverse-engineer, disrupt, or gain unauthorized access to the Site;
Submitting false information to bypass age or eligibility verification; or
Any use in violation of applicable laws or these Terms.

11. Disclaimers & Warranties

The Site and products are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We warrant only that products meet the Certificate of Analysis (“COA”) specifications provided at the time of shipment when stored per instructions.

12. Limitation of Liability

To the maximum extent permitted by applicable law, VivaLongevity, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data arising from your use of the Site or products. Our aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless VivaLongevity from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of products, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will survive.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute shall be resolved by binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree to waive any right to a jury trial or to participate in a class action.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Your continued use of the Site after a change constitutes acceptance of the updated Terms.
